What is the Madrid Protocol?
The Madrid Protocol is an international treaty administered by the World Intellectual Property Organization (WIPO) that allows trademark owners to seek protection in multiple countries through a single application. Instead of filing separate trademark applications in every country where you want protection, U.S. trademark owners can file one international application through the United States Patent and Trademark Office (USPTO) and designate any of the 110+ member countries and regions covered by the treaty.
How it works for U.S. filers
- Start with a U.S. base. You must have a pending application or existing registration with the USPTO. This serves as the “basic mark” that anchors your international filing.
- File through the USPTO. Submit a single international application to WIPO through the USPTO, selecting the countries where you want protection.
- WIPO reviews and forwards. WIPO performs a formalities check, then notifies each designated country's trademark office to examine the mark under their local law.
- National examination. Each country's trademark office has 12–18 months to approve or refuse the mark. If no refusal is issued, protection is granted.
